For a DUI suspension or revocation order, California DMV says you have 10 days from receiving the order to request a DMV hearing. Do not wait for your court date. Shortly after you’ve shaken the initial shock that often comes from receiving a DUI, you will want to quickly find an attorney experienced in the matter with fair payment agreements. Being smart about where you put your money here is important, as the DUI process can get very expensive, quickly.
Ask whether representation includes both the criminal case and the DMV hearing, what the fee covers, and whether payment arrangements are available. If you cannot afford an attorney for your criminal case, tell the judge at arraignment and ask about a court-appointed attorney. An SR-22 is a California Insurance Proof Certificate issued through an insurer as evidence of financial responsibility. It is connected to insurance coverage; it is not a separate policy or a driver's license. Ask which policy supports the filing and what that policy actually covers. An ignition interlock device, or IID for short, is installed in a vehicle and checks a breath sample before the engine can start. It can be court-ordered or part of a restricted-license option. Whether it applies, and for how long, depends on your case.
Before paying for installation, confirm the requirements and use California's official installer guidance. Ask about the total cost and any available financial assistance. An IID or an SR-22 alone does not establish that you may drive. Finally, a licensed DUI education and counseling program may be among your requirements. The program and its length depend on your case and orders. Use the California Department of Health Care Services provider directory and confirm the required program, approved attendance format and fees before enrolling. Keep your notices, receipts and proof of enrollment or completion together. If something is unclear, ask your attorney, DMV or the licensed program which requirement applies.
